    order with The Cupcake Patisserie, you acknowledge and agree to the following terms
    and conditions.
  2. Amendment of Terms The Cupcake Patisserie reserves the right to modify these terms
    at any time. Your continued use of our website or placing an order signifies your
    acceptance of any changes.
  3. Limitation of Liability The Cupcake Patisserie is not liable for any loss or damage related
    to your use of the website, products, or services. This includes reliance on third-party
    content, links, or advertisements. Your use of the website is at your own risk.
  4. Competition and Consumer Act As per the Australian Consumer Law, The Cupcake
    Patisserie’s liability for any breach is limited to re-supplying goods or services, replacing
    goods, or paying the cost of re-supplying goods or services. Users must be over 18 years
    old to use our website or purchase goods and services.
  5. Order Confirmation Full payment is required to confirm orders. The Cupcake Patisserie
    reserves the right to cancel unpaid orders. Online orders require full payment at
    checkout.
  6. Delivery of Goods All orders are delivered by The Cupcake Patisserie on the date
    specified in the order. Standard delivery occurs between 8am and 5pm AEST, while
    priority delivery offers a 1-hour window of choice. The customer is responsible for
    ensuring someone is available to receive the order. A fee may be payable for any orders
    requiring redelivery.
    Any liability for damaged, lost, or stolen goods ceases upon delivery. Priority deliveries
    arriving outside the agreed window by more than 30 minutes qualify for a delivery fee
    refund.
  7. Order Changes, Cancellations, and Refunds
    If you wish to modify the date, alter order details, or cancel your order entirely, please
    contact us with as much advance notice as possible.
    Cancellations made over 30 days from the delivery date qualify for a full refund.
    Cancellations between 7 and 30 days from the delivery date receive a 50% refund of the
    total order value.
    No refunds are available for cancellations within 7 days or less from the delivery date.
    Orders not paid within 14 days of the delivery date will be treated as cancelled.
    Changes to order details, including quantity or flavours, are subject to approval at the
    discretion of The Cupcake Patisserie.
  8. Returns The Cupcake Patisserie adheres to Australian Consumer Protection legislation
    for returns. Due to hygiene and food regulations, we do not accept returns. Refunds,
    credit notes, or replacement orders will be considered if the received products are
    incorrect or of unsatisfactory quality, subject to our discretion.
  9. Food Allergens We cater to special dietary needs, such as gluten-free, dairy-free, and
    vegan requirements. It’s important to note that despite all precautions taken, our
    products are prepared in the same kitchen facilities and with shared utensils. As a
    result, there is a possibility that our products may contain traces of some allergens.
